HC-KAR NC: 2025:KHC:37801 WP No. 35742 of 2024
ORAL ORDER Aggrieved by the
order passed in I.A.No.2 in Crl.Misc.No.3/2024 dated 25.11.2024 by the III Addl. Principal Judge, Family Court, Mysuru, whereby the Family Court had granted maintenance of an amount of Rs.10,000/- per month to the child, the husband is before this court. 2. The parties are referred to as husband and wife for the sake of convenience. 3. It is the case that the wife had filed I.A.No.2 seeking maintenance of an amount of Rs.20,000/- per month each to herself and to the daughter and to pay the educational expenses of the daughter and also Rs.30,000/- towards litigation expenses. The facts of this case are that both the husband and wife are working. The husband’s salary is Rs.34,357/- per month. The wife’s salary is Rs.35,996/- per month and her take home salary is Rs.19,506/- per month. The Family Court had considered both the aspects and also the fact that the daughter is studying in a school where her educational expenses are very high. According to the learned counsel for the respondent/wife, it is more than Rs.1,50,000/- per annum. - 4 -

The Family Court had granted maintenance of an amount of Rs.10,000/- per month. 4. Learned counsel appearing to the petitioner/husband submits that the wife had deserted the husband and she is staying separately. He has a responsibility to take care of the child, but she is earning more salary than the husband and it is the equal responsibility of both the parents. It is submitted that if there is any scope for reconciliation, the husband is ready to take back the wife and child. 5. Learned counsel appearing for the respondent/wife submits that the wife is not interested for a reunion. It is submitted that if the husband is ready to come to Mysore and settle with them, then the wife has no objections for the reunion. 6. Having heard the learned counsels on either side, perused the material on record. Considering the income of both the parties and the fact that the wife alone is taking care of the child and the educational expenses are on the higher side, the Family Court had rightly granted maintenance of an amount of Rs.10,000/- and this Court finds no reason to interfere with the
