The present writ petition has been filed challenging the impugned First Information Report dated 13.06.2025 lodged at Case Crime No. 0209 of 2025, under Section 108 The Bharatiya Nyaya Sanhita, 2023 and 3(2)(V) of The Scheduled Castes and The Scheduled Tribes (Prevention of Atrocities) Act, 1989, Police Station Mahuli, District Sant Kabir Nagar. It has been argued by the counsel for the petitioner that the recitals in the First Information Report, even if accepted, do not disclose an offence under Section 108 of the B.N.S., 2023. It has been argued that the suicide by the deceased Manish Kumar was because of undue sensitivity and cannot be imputed to the petitioner. The AGA and the counsel for respondent no. 4 have opposed the petition. In the circumstances of the case and after considering the rival arguments of the counsel for the parties, the writ petition is disposed of with a direction that the petitioner shall not be arrested in pursuance to the First Information Report dated 13.06.2025 lodged at Case Crime No. 0209 of 2025, under Section 108 The Bharatiya Nyaya Sanhita, 2023 and 3(2)(V) of The Scheduled Castes and The Scheduled Tribes (Prevention of Atrocities) Act, 1989, Police Station Mahuli, District Sant Kabir Nagar till submission of the police report under Section 193 of Bhartiya Nyaya Sanhita, 2023.
