This application has been filed for cancellation of the bail granted to Opposite Party Nos. 2 to 5 by the learned Additional Sessions Judge-II, Katihar, vide his order dated 01.03.2025 passed in B.P. Nos. 176/2025, 200/2025 and 201/2025, in connection with Pothiya P.S. Case No. 101/2024, instituted for the offences punishable under Sections 80(2) and
Patna High Court CR. MISC. No.35909 of 2025(3) dt.15-07-2026 2/2 61 of the Bharatiya Nyaya Sanhita (B.N.S.).
3. Perused the records. Having considered the facts and circumstances of the case and the materials available on record, I am not inclined to interfere with the impugned order.
4. Accordingly, the present application stands dismissed.
5. Since the charge-sheet has already been filed, the learned Magistrate is directed to commit the case to the Court of Sessions. Thereafter, the trial shall be expedited and concluded within a period of one year from the date of framing of charge. The Opposite Parties shall not delay the proceedings, particularly the framing of charge, by filing unnecessary applications for discharge.
6. Let a copy of this order be communicated to the Principal District & Sessions Judge, Katihar through FAX or e- mail for immediate compliance.
