For Petitioner : Dalit Tiger C.Ponnusamy For Respondents: Mr.R.Ganesh Kumar Counsel for Government of Tamil Nadu (Criminal Side) ORDER This Writ Petition (Criminal) has been filed seeking a direction to the respondents 1 and 2 to provide adequate police protection to the petitioner to take possession of the property comprised in Survey No.709/2, situated at Madambakkam Village, Tambaram Taluk, Chengalpattu District, as per the order passed by the third respondent dated 06.06.2025. https://www.mhc.tn.gov.in/judis WP Crl. No. 1317 of 2025 __________ Page3 of 6 2. Heard the learned counsel appearing on either side and perused the materials available on record. 3. The petitioner’s paternal grandfather, viz., K.Ekambaram, was working as a Jamedor in Indian Military during the British period. He was granted temporary assignment patta for the property to an extent of 5 acres by order dated 29.06.1920. Subsequently, the same was classified and confirmed by the third respondent. The petitioner and others, being legal heirs of the said Ekambaram, were in possession and enjoyment of the same. In the meanwhile, the respondents 4 to 8 encroached the said property and as such, the petitioner could not able to take possession of the subject property. Hence, the petitioner submitted a representation seeking police protection to take possession of the subject property. 4. Though the petitioner’s grandfather was assigned the subject land and the same was confirmed by the third respondent, the private persons have now encroached the subject property. In order to evict them, the petitioner sought for police protection. However, the police protection cannot be granted for the simple reason that the private persons are in occupation of the land https://www.mhc.tn.gov.in/judis WP Crl. No. 1317 of 2025 __________ Page4 of 6 which was originally assigned in favour of the petitioner’s grandfather. Therefore, the petitioner ought to have approached the Civil Court for appropriate relief against the persons who have illegally occupied the property, in the manner known to law. 5. In view of the above, the representation submitted by the petitioner cannot be considered. Thus, the writ petition lacks merits and is liable to be dismissed.
