Mr. T. M. Shah, learned counsel for the petitioner has fairly admitted in the open court that petitioner furnished an Undertaking/Bond in the Court of learned Principal Sessions Judge, Shopian (“the appellate court”), by virtue of which he undertook to pay Rs. 5.00 lacs in the said court within 15 days & Rs. 2.50 lacs after next 15 days and the said undertaking was taken on record by the Court. After brief submissions, learned counsel for the petitioner seeks to withdraw the present petition. However, he seeks extension of time for deposition of 1st installment before the appellate court. His statement is taken on record. In view of the above, the present petition is dismissed as withdrawn. However, the time to deposit the 1st installment of Rs. 5.00 lacs before the appellate court is extended by one week from today. Rest of the impugned
order is upheld.
