CORAM: HON'BLE MR. JUSTICE MOHAMMAD NAWAZ ORAL ORDER Petitioners are seeking to quash the entire proceedings in C.C.No.3084/2024 pending before the learned II Additional Civil Judge and JMFC Court, Chitradurga. - 3 -

It is contended by the learned counsel for petitioners that the present case is a counter blast to the case registered against respondent No.2 and others and even earlier there were cases registered and compromised. He contended that there is a civil dispute and to settle a score and to pressurize the petitioners, a false case is registered against the petitioners, making baseless allegations. 3. Learned HCGP has contended that there are specific allegations in the complaint and there are eyewitnesses to the incident apart from the injured witnesses. He further contended that in the proceedings initiated on a complaint lodged by petitioner No.1, charge sheet is filed. 4. The material on record reveals that in respect of an incident which took place on 04.03.2024 at about 12.45 - 12.50 p.m., both the parties have lodged complaint against each other. 5. On a complaint lodged by respondent No.2, FIR is registered against petitioners No.1 to 4 for the offence punishable under Sections 323, 324, 504, 506 r/w 34 of IPC. - 4 -

On completion of investigation, charge sheet has been filed. Similarly, on a complaint lodged by petitioner No.1 herein, a case in Crime No.67/2024 was registered at Bharamasagara Police Station, Chitradurga, against the second respondent herein and two others for the offence punishable under Sections 506, 504, 323, 324 r/w 34 of IPC. Even in the said case, the charge sheet has been filed. 6. As per the complaint averments, on 04.03.2024 at about 12.45 p.m., the accused went near the house of the complainant, picked up a quarrel with the complainant's husband, abused and assaulted with hands and also assaulted the complainant with a stone. Further, threatened the complainant and others with dire consequences etc.,. 7. The contention of the learned counsel that the allegations against the petitioners are false etc., cannot be accepted at this stage. As submitted by the learned HCGP there are eye witnesses to the incident, apart from the injured. 8. There is a case and counter case.
In view of the prima facie materials and filing of charge sheet, proceedings

can not be quashed. Moreover, in the counter case registered on a complaint lodged by the first petitioner, charge sheet is filed and the proceedings in the said case are pending. Petitioners are at liberty to seek discharge before the trial Court, if so advised. Petition is dismissed. IA No.1/2025 is disposed of. Sd/- (MOHAMMAD NAWAZ) JUDGE
