ORDER DATED
01.06.2022 PASSED IN Crl.MISC.NO.447/2018 ON THE FILE OF THE JUDGE, FAMILY COURT, DAVANAGERE, PARTLY ALLOWING THE PETITION FILED U/S.125 OF Cr.P.C FOR MAINTENANCE.
THIS PETITION, COMING ON FOR ADMISSION, THIS DAY,
ORDER WAS MADE THEREIN AS UNDER:
CORAM:
HON'BLE SMT. JUSTICE LALITHA KANNEGANTI ORAL ORDER
Aggrieved by the order passed in Crl.Misc.No.447/2018 dated 01.06.2022 by the Family Court, Davanagere, whereby the Family Court had granted maintenance of an amount of Rs.3,000/- per month to the wife and an amount of Rs.1,500/- each to the children, the petitioner/husband is before this Court.
2. The parties are referred to as husband and wife for the sake of convenience.
3. Learned counsel appearing for the petitioner/husband submits that earlier the husband was earning an amount of

Rs.6,000/- per month and now he has sustained injuries and is not in a position to earn and pay the maintenance.
4. By order dated 18.07.2025, notice to respondents is deemed to be served.
5. Having heard the learned counsel for the petitioner, perused the entire material on record. The Family Court by way of impugned order had granted an amount of Rs.3,000/- per month to the wife and an amount of Rs.1,500/- each per month to the children. Altogether, the Family Court had granted an amount of Rs.6,000/- per month to the wife and the children. Even if the minimum wages are taken into consideration, the amount that is granted by the Family Court is not exorbitant. It is submitted by the learned counsel for the petitioner that the husband is having some medical issues. In that regard, no evidence is placed before the Court and in the considered opinion of this Court, there are no grounds to interfere with the
order passed by the Family Court. Hence, this Court is passing the following order:
