2. Petitioner has been made accused in connection with S.T. No. 334 of 2023 arising out of Dugda P.S. Case No. 0012 of 2023 for the offences registered under sections 364, 302, 201 and 120B/34 of the Indian Penal Code, pending in the court of learned Additional Sessions Judge, 1st, Bermo at Tenughat.
3. Bail application of the petitioner was earlier rejected by this court vide B.A. No. 776 of 2024 by order dated 03.05.2024.
4. On 09.02.2023, son of the Informant namely Aryawan Deo went missing. During the course of investigation, petitioner was apprehended and, on his confession, dead body of the deceased was recovered from a well near Kumaliya Dam.
5. Report regarding the stage of the trial earlier called for, has been received. It appears that out of eight witnesses, six have already been examined in this case and the trial is likely to be concluded within three months.
6. Considering the nature of allegation and the fact that the trial is at the fag end of its conclusion, I am not inclined to enlarge the petitioner on bail. Accordingly, his prayer for bail stands rejected, at this stage.
