JUSTICE SHIVASHANKAR AMARANNAVAR ORAL ORDER This petition is filed by petitioners/accused Nos.2 to 4 under Section 482 of Bharatiya Nagrika Suraksha Sanhita, 2023 (hereinafter referred to as 'BNSS') seeking anticipatory bail in Crime No.480/2025 registered by Sira Police Station, Tumakuru for the offence punishable under Sections 108, 85 read with 3(5) of BNS 2023, pending on file of Prl.Civil Judge (Sr.Dn) and CJM Court, Sira, Tumakuru district. 2. Learned counsel for petitioners files memo stating that the petitioner No.3/accused No. 4 has been arrested - 3 - HC-KAR NC: 2025:KHC:52830 CRL.P No. 15766 of 2025 and subsequently she has been granted bail by the Sessions Court and prays to withdraw the petition, so far petitioner No.3/accused No. 4 is concerned. 3. Heard learned counsel for the petitioners and the learned High Court Government Pleader for respondent. 4. Learned counsel for petitioners would contend that the marriage of accused No.1 with the deceased was love marriage and they were residing in Jyothinagar of Shira town and they had a son. The petitioner Nos.1 and 2/accused Nos. 2 and 3 were parents of accused No.1 and in-laws of deceased were residing in Mosarukunte Village of Sira Taluk and they were not residing with the deceased and accused No.1. The accused No.1 has been granted anticipatory bail by the Sessions Court in Crl.Misc.1490/2025 by order dated 18.10.2025. The petitioner No.3/accused No.4 has been granted bail by the Sessions Court in Crl.Misc.1777/2025 by order dated 05.12.2025. - 4 - HC-KAR NC: 2025:KHC:52830 CRL.P No. 15766 of 2025 5. The allegation against accused No.1 and the petitioners are similar. The petitioners are ready to cooperate with investigating officer in investigation. The offence alleged against petitioners are not punishable with death or imprisonment for life. With this, he prayed to allow the petition. 6. Per contra, learned Addl.SPP would contend that the investigation is over and charge sheet has been filed. There is a prima facie case against the petitioners for offence alleged against them. With this, she prayed to reject the petition. 7. Having heard the learned counsels appearing for the parties, this Court has perused the FIR, complaint and other materials placed on record. 8. The allegation against the accused persons is harassing the deceased physically and mentally and due to which the deceased committed suicide by hanging in the rented house, wherein she and the accused No.1 were - 5 - HC-KAR NC: 2025:KHC:52830 CRL.P No. 15766 of 2025 residing. The copies of Aadhar card of petitioner Nos.1 and 2/accused Nos. 2 and 3 indicate that they are residing in Mosarakunte Village of Shira Taluk. The petitioner Nos.1 and 2 were not residing with the deceased and accused No.1. 9. The allegation against all the four accused is similar. The accused No.1 has already been granted anticipatory bail by the Sessions Court and accused no.4 has been granted regular bail by the Sessions Court. The petitioners have undertaken to cooperate with Investigating officer in investigation and abide by any conditions to be imposed by this Court. 10. Considering the above aspects, the petitioners Nos.1 and 2 have made out case for grant of anticipatory bail with conditions. In the result, I pass the following: - 6 - HC-KAR NC: 2025:KHC:52830 CRL.P No. 15766 of 2025 ORDER This Criminal Petition filed by the petitioner Nos.1 and 2/accused Nos.2 and 3 is allowed. The petition against petitioner No.3/accused No.4 is dismissed as not pressed. The petition filed by the petitioner Nos.1 and 2/accused Nos.2 and 3 are ordered to be released on bail, in the event of their arrest in Crime No.480/2025 registered by Sira Police Station, Tumakuru for the offence punishable under Sections 108, 85 read with 3(5) of BNS 2023, pending on Prl.Civil Judge (Sr.Dn) and CJM Court, Sira, Tumakuru, subject to following conditions: (i) The petitioner Nos.1 and 2/accused Nos.2 and 3 shall appear before the jurisdictional court/investigating officer within 10 days from this petition and shall execute a personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) each, with one surety for the likesum to - 7 - HC-KAR NC: 2025:KHC:52830 CRL.P No. 15766 of 2025 the satisfaction of the jurisdictional court/investigating officer. (ii) The petitioner Nos.1 and 2/accused nos.2 and 3, shall not tamper the prosecution witnesses either directly or indirectly. (iii) The petitioner Nos.1 and 2/accused Nos.2 and 3, shall appear before the Trail Court on all the dates of hearing unless exempted by the Court and cooperate for the speedy disposal of the case.
