JUSTICE MOHAMMAD NAWAZ ORAL ORDER These petitions arise out of Crime No.281/2025 registered at Nelamangala Rural Police Station, Bangalore Rural District. Hence, taken up together and disposed of by this common order. 2. Heard the learned counsel for petitioners, learned Additional SPP for the State and perused the material on the record. 3. FIR is registered on a complaint lodged by one Girish.R. against two named accused and 6 to 7 others, for the offence punishable under Section 109(1), 115(2), 118(1), 351(2), 352 AND 190 OF BNS, 2023. 4. It is alleged that on 03.08.2025 at about 08.30 p.m., the complainant and his friends namely Harish, Manjunatha and Govindraj were coming out of Green Park dhaba, after finishing their dinner. The shoulder of the complainant touched one of the accused. Accused No.1 - Seemenne Devaraju started hurling abuses against the complainant. When complainant’s friends intervened, they were assaulted with hands. Thereafter, the people present in the dhaba pacified the quarrel and sent them. After sometime, when the complainant and his friends were drinking tea in one RRR Cafe, the accused who had followed them, picked up quarrel and accused No.1 stabbed the complainant with a knife on his chest and back and also caused injuries to Govindaraju and Manjunath, when they tried to intervene. 5. Crl.P.No.12756/2025 and Crl.P.No.12747/2025 are preferred by accused Nos.1 and 3 respectively, seeking anticipatory bail. Crl.P.No.12616/2025 is preferred by accused No.4 seeking regular bail. 6. It is submitted by the learned Addl.SPP that accused No.1 has three more criminal cases registered - 6 - HC-KAR NC: 2025:KHC:38480 CRL.P No. 12616 of 2025 C/W CRL.P No. 12747 of 2025 CRL.P No. 12756 of 2025 against him and he is a rowdy sheeter in Nelamangala Town and Rural Police Stations. 8. In the complaint, specific overt acts of inflicting injuries to the complainant and others are attributed against accused No.1. Considering his criminal antecedents, he is not entitled for the relief of anticipatory bail, though the injuries sustained by the complainant - Girish.R and Govindaraju are simple in nature. The relief sought by accused Nos.3 and 4 can be granted by imposing suitable conditions. Accordingly, the following: ORDER Crl.P.No.12756/2025 is dismissed. Crl.P.No.12747/2025 and Crl.P.No.12616/2025 are allowed. Petitioner/accused No.4 - Murali in Crime No.281/2025 registered by Nelamangala Rural Police Station, shall be enlarged on bail, subject to following conditions: 1. He shall execute a personal bond for a sum of Rs.50,000/- (Rupees Fifty - 7 - HC-KAR NC: 2025:KHC:38480 CRL.P No. 12616 of 2025 C/W CRL.P No. 12747 of 2025 CRL.P No. 12756 of 2025 thousand only) with two sureties for the likesum to the satisfaction of the jurisdictional Court. 2. He shall furnish proof of his residential address and shall inform the Court, if there is change in the address. 3. He shall not leave the jurisdiction of the trial Court without prior permission of the learned Sessions Judge. 4. He shall not tamper with the prosecution witnesses either directly or indirectly. 5. He shall appear before the trial Court on all dates of hearing without fail. Violation of condition/s shall result in cancellation of bail.
