JUSTICE SUNIL DUTTA MISHRA ORAL ORDER 5 21-03-2025 Learned counsel for the parties submit that the impugned order dated 05.02.1998 passed by Deputy Director of Consolidation, Vaishali at Hajipur in Case No.05 of 1997-98 is also subject matter in Title Suit No.556 of 2002 pending before Patna High Court CWJC No.2113 of 2019(5) dt.21-03-2025 2/2 the court concerned. They also pointed out that vide order dated 05.02.2019 a coordinate bench of this court has directed that till further order(s), the impugned order dated 05.02.1998 shall not be given effect to and shall not be taken cognizance for any purpose. 2. Learned counsel for the parties further submit that since the impugned order dated 05.02.1998 is subject matter in Title Suit No.556 of 2002, this case may be disposed of. 3. Learned counsel for the State has no objection to this prayer of the petitioner. 4. In view of the above submissions of learned counsel for the parties, since the impugned order dated 05.02.1998 is subject matter of title suit pending before the court concerned, this writ petition is disposed of. 5. It is needless to say that the impugned order dated 05.02.1998 shall not be given effect to and shall not be taken cognizance for any purpose till final outcome of Title Suit No.556 of 2002 pending before the court concerned.
