Writ petitioners allege inaction on the part of the respondent no. 3 i.e., Asanasol Durgapur Development Authority in disposing of the petitioners’ application for conversion of R.S. Plot 1317 (now L.R. Plot No. 672) Mouza – Sitla, J.L No. 25 District – PaschimBardhaman from baid to bastu. 3. It is submitted by the petitioners thatJamiatAhleHadees Trust, Asansol has purchased a plot of land, the nature whereof is baid. The petitioner no. 1 claims to be the settlor of the said Trust and the petitioner no. 2 claims to be its Secretary. The petitioners submit that the said Trust intends to convert 2 the same from baid to bastu and for such conversion a “No-Objection” of the respondent no. 2 is required. For the purpose of obtaining such No-objection that an application has been made by the petitioners to the respondent no. 3 which has not yet been disposed of. 4. It is submitted by the learned Advocate appearing for the respondent nos. 2 to 4 that a decision as regards conversion can only be taken by the Chief Executive Officer of Asansol Durgapur Development Authority and not by the Chairman. 5. Having heard the learned Advocates appearing for the respective parties and having considered the material on record,this writ petition is disposed of by directing the Chief Executive Officer, Asansol Durgapur Development Authority to consider and dispose of the petitioners representation dated January 14, 2025 (Annexure- P3 at Page 39 of the writ petition) within a period of four weeks from the date of communication of the order, strictly in accordance with law, upon giving an opportunity of hearing to the petitioners. Needless to mention that the 3 authority shall dispose of the representation by passing a reasoned order and within the time aforesaid and communicate the same to the petitioners within a week from passing thereof. It is clarified that this Court has not gone into the merits of the case and the authority concerned i.e., the Chief Executive Officer shall be free to take a decision as to whether “No-Objection” should be granted in favour of the purchaser Trust ornot, in accordance with law. 6. W.P.A 3272 of 2025 stands disposed of with the above observations. No costs. 7. Urgent certified website copy of this order, if applied for, be given to the parties upon compliance with all requisite formalities. (Om Narayan Rai, J.)
