This criminal miscellaneous petition has been filed under section 528 of the Bhartiya Nagrik Suraksha Sanhita, 2023 by the petitioner with a prayer for modification of the order dated 25.06.2024, in B.A. No. 4877 of 2024, passed by a Co-ordinate Bench of this Court whereby the Co-ordinate Bench of this Court granted regular bail to the petitioner subject to the condition that the petitioner shall remain present on each and every date before the trial court. It is submitted by the learned counsel for the petitioner that the petitioner has complied the said order dated 25.06.2024, in B.A. No. 4877 of 2024, passed by a Co-ordinate Bench of this Court but she has become pregnant in the meanwhile and has been advised bed rest by the Gynecologist. Hence, it is submitted that the said condition be waived. The learned Addl. P.P. has no objection to the aforesaid prayer. Considering the facts of the case, the said order dated 25.06.2024, in B.A. No. 4877 of 2024, passed by a Co-ordinate Bench of this Court is modified by waiving the condition that the petitioner shall remain present on each and every date before the court below concerned but in case, the petitioner remains absent, she must ensure that she is represented by her Advocate before the court below concerned. The order dated 25.06.2024, passed in B.A. No. 4877 of 2024 is modified to the aforesaid extent only. This criminal miscellaneous petition is disposed of accordingly.
