JUSTICE SANDEEP KUMAR ORAL ORDER 3 15-07-2026 Heard the learned counsel for the petitioner and the learned counsel for the State. 2. This application has been filed for cancellation of the anticipatory bail granted to Opposite Party No. 2 vide order dated 12.06.2025 passed by the Learned Additional Sessions Judge–I, Bhagalpur, in Anticipatory Bail Petition No. 917 of 2025 arising out of Lalmatia P.S. Case No. 49 of 2024, registered under Sections 316(2), 318(4), 338, and 336(3) of the Bharatiya Nyaya Sanhita. 3. It is the contention of the learned counsel for the petitioner that the impugned order granting anticipatory bail has Patna High Court CR. MISC. No.58452 of 2025(3) dt.15-07-2026 2/2 been passed without proper appreciation and consideration of the facts and circumstances of the case. 4. Perused the records. Having considered the facts and circumstances of the case and the materials available on record, this Court finds no ground to interfere with the impugned order. 5. Accordingly, the application stands dismissed. However, the Sub-Judge-I/concerned Court, Bhagalpur is directed to conclude the Title Partition Suit No. 361 of 2024 within one year from the date of receipt/communication of a copy of this order. The Court below shall proceed ex-parte against the non-cooperating party. If any application for injunction/receiver is filed by either of the parties, the same shall be disposed of within one month of its filing. 6.
