Neutral Citation No. - 2025:AHC:107754-DB Court No. - 21 Case :- SPECIAL APPEAL No. - 624 of 2025 Appellant :- Anil Kumar Singh Respondent :- Union Of India And 2 Others Counsel for Appellant :- Abhishek Pandey,Jitendra Nath Pandey Counsel for Respondent :- A.S.G.I. Hon'ble Manoj Kumar Gupta,J. Hon'ble Ram Manohar Narayan Mishra,J. 1. The instant intra court appeal is directed against the order of learned Single Judge dated 19.05.2025 in Writ-A No. 13335 of 2023 filed by the appellant (hereinafter referred as 'the petitioner') praying for a direction to respondent no.2 to decide his representations dated 25.07.2022 and 11.07.2023 by a reasoned and speaking order. 2. Learned Single Judge has considered the case of the petitioner wherein the prayer made was for grant of pensionary benefits. The order records that the petitioner was dismissed from service and, subsequently, the dismissal was upheld by the Supreme Court. In the aforesaid facts and circumstances, the learned Single Judge has held that the petitioner would not be entitled to any pension. 3. Reliance placed by the petitioner on a Government Order dated 28.08.2020 in respect of grant of pension to a government servant, who has completed thirty years of qualifying service and is retired in public interest, has also been repelled after holding that the the same would not be attracted to the facts of the case of the petitioner, as he was terminated by way of punishment and was not retired in public interest. 4. Learned counsel for the petitioner again placed reliance on the same Government Order in contending that the petitioner would be entitled to pension. 5. The punishment order has not been annexed by the petitioner. Even, the order of the Supreme Court, by which the Supreme Court dismissed the petition filed by the petitioner and upheld the order of dismissal of the petitioner, has not been annexed. 6. In such a situation, we find no illegality in the impugned order of learned Single Judge. 7. The appeal lacks merit and is, accordingly, dismissed. 8. The order has been passed in the presence of Shri Sunil Sharma, learned counsel for the respondents. (Ram Manohar Narayan Mishra, J.) (Manoj Kumar Gupta, J.) Order Date :- 8.7.2025 Ankit.
