HON'BLE SRI JUSTICE K.SURESH REDDY CRIMINAL PETITION No. 1473 OF 2025
ORDER:
As per the directions of My Lord the Hon'ble the Chief Justice, this criminal petition has been allotted to this Bench by notice dated 25-03-2025 and the same is treated as part of the roster effective from 26-03-2025.

This criminal petition, under Section 482 of Bharatiya Nagarik Suraksha Sanhita, is filed by the petitioner-accused seeking to release her on bail in the event of arrest in crime No. 26 of 2025 of Chilakaluripet Town Police Station, Palnadu District, registered for the offences punishable under Sections 336 (3), 316 (5) and 318 (4) of Bharatiya Nyaya Sanhita.
3. Heard Sri T.Ramakoteswara Rao, learned counsel appearing for the petitioner-accused, and learned Additional Public Prosecutor appearing for the respondent-State.
4. Case of the prosecution is that the petitioner is working as computer operator on outsourcing basis in Chilakaluripet Municipality. She used to collect rents from the tenants of the shops belonging to Chilakaluripet Municipality and used to deposit
2 the same in municipal treasury. As there are certain irregularities during the years 2021- 2022 and 2022-2023, the petitioner has been asked to show entire accounts. On verification of the accounts, it has come to light that the petitioner misappropriated an amount of Rs.28,16,487/-. In spite of repeated demands, the petitioner did not respond either in office or at home. Consequently, the Commissioner, Chilakaluripet Municipality, lodged a report to police, on the basis of which the present crime has been registered against the petitioner.

Learned counsel appearing for the petitioner-accused would contend that the petitioner is working as computer operator on outsourcing basis and regular employees are involved in misappropriation of funds belonging to the Municipality and that the petitioner gave a report to police bringing to their notice about the involvement of regular office staff. He therefore requests this Court to grant anticipatory bail to the petitioner-accused.
6. Learned Additional Public Prosecutor on the other hand opposed the criminal petition on the grounds that the petitioner alone is responsible and there is no other officer looking after the
3 deposit of rents into municipal treasury and that in spite of repeated demands, there was no response from the petitioner.
7. This Court has perused the entire material available on record. As the petitioner alone is responsible for depositing of rents into municipal treasury and as there was no response from the petitioner in spite of repeated demands from the municipal authorities, this Court is not inclined to grant anticipatory bail to the petitioner-accused.
8. Accordingly, the criminal petition is dismissed.
