And 2 Others Counsel for Petitioner :- Satish Chandra Dubey Counsel for Respondent :- C.S.C. Hon'ble Ajit Kumar,J. 1. Heard Sri Satish Chandra Dubey, learned counsel for the petitioner and learned Standing Counsel for the State. 2. By means of this petition filed under Article 226 of Constitution of India, the petitioner has assailed the order of transfer on the ground that petitioner's child suffers from autism and speech therapy session is given to the child at Bareilly and if he is transferred from Budaun to Jaluan as the order has been passed, major health issue will arise as the child is undergoing session and petitioner has to undertake this exercise of taking child to Bareilly quite often. 3. The submission advanced by learned counsel for the petitioner that the petitioner had also taken his child previously to Sir Ganga Ram Hospital, New Delhi and AIIMS, New Delhi. He has also submitted the medical certificate given by qualified medical practitioners, copy whereof has been placed at Page 45 and submits that petitioner's child is suffering 75 per cent disability. It is argued next that the petitioner may be transferred to any district which may be near to the district of Bareilly. Transfer to Jalaun is like denying to give better treatment to his child. 4. On the contrary, learned Standing Counsel submits that the petitioner has over stayed at district Bareilly i.e. 14 years and now he has been transferred to Jalaun. He is not averse to the petitioner's request to be directed to be reconsidered for transfer to nearby district by the Competent Authority in accordance with law. 5. In view of the above, I dispose of the petition with direction to the petitioner to make a fresh representation before the competent authority namely, respondent no.2 within a period of two weeks from today annexing therewith all the medical papers regarding treatment of his child who suffers from autism and in the event petitioner makes a representation as directed hereinabove, the same shall be disposed of within a further period of two weeks. 6. It is further provided that a sympathetically consideration shall be provided to the petitioner's request to place him in the district nearby Bareilly so that petitioner's child continues to get treatment at Bareilly. 7. For a period of 45 days or till the decision is taken by the authority, if petitioner is not relieved pursuant to the transfer order, he shall not be relieved.
