This first bail application has been moved by the applicant seeking regular bail in Case Crime/F.I.R. No.545 of 2023, under Section 302, 504, 506 I.P.C. and Section 3/25 of the Arms Act, registered at Police Station Rudrapur, District Udham Singh Nagar. 3. It is contended by learned counsel for the applicant that applicant has falsely been implicated in the instant crime; has no criminal history and is languishing in jail since 02.10.2023. Learned counsel for the applicant submits that the Ballistic Report does not match with the prosecution version. He submits that, as per recovery memo, country-made pistol of .315 bore was recovered, however, perusal of medical report reveals that the injury caused on the person of the deceased was not caused by the said weapon and there were 3 pellet injuries, beside this, the Ballistic report also fortifies the arguments of the counsel for the applicant that the gunshot injuries on the body of the deceased were not caused by the seized weapon. He submits that applicant is about 70 years of age and is suffering from various old age ailments. 2025:UHC:3773 He submits that in case, the applicant is granted bail, he will not misuse the same and will furnish the bail surety as per the satisfaction of this Court. 4. Learned State Counsel as well as learned counsel for the complainant vehemently opposed the bail application. 5. Considering the submission of learned counsel for the parties and without expressing any opinion as to the final merits of the case, this Court is of the view that applicant deserves bail at this stage. 6. The bail application is allowed. 7. Let the applicant, namely, Suchcha Singh be released on bail, on executing personal bond and furnishing two reliable sureties, each of like amount, to the satisfaction of Court concerned.
