The Criminal Petition, under sections 480 and 483 of the Bharatiya NagarI'k Suraksha sanhita, 2023, is filed on behalf of the petl-tl'oner/accused No.2 seeking regular baI'I in Crime No.232 of 2024 of Narsl®patnam Town Police Station, Anakapalli District registered for the offences punishable under sectI-OnS 318 (4) BNS, 66-C, 66-D of the lT Act. €=-,E3 '`-`tT3 2. Brief case of the prosecution is that, on 14.ll.2024 at about 13.00 hours, the de-facto complainant lodged a report stating that on 04.ll.2024 , at about 10/3O hours, he received a phone call from one Rajesh Kumar Choudhary from TRAl, provided an lD number (TDI143131), and claimed that a money laundering case has been registered against him in Mumbai. The said call was transferred to a Whatsapp number 7970340734 allegedly belonging to Mumbai Police. They instructed him not to disclose the matter to anyone, citing orders from the Finance Ministry. The caller alleged that his Canara Bank account bearing No.403101206666 was linked to money laundering case involving Rs. 2950,00,000/- and a falsified bank statement was sent to him, and the caller demanded payment to close the case and also obtained his bank details. Believing the claims to be true and out of fear, he transferred a total amount of Rs.1,43,20,000/-to the accounts provided by the fraudsters. The fraudsters sent identical receipts for all the transactions and upon realizing that he had be2en defrauded of Rs.1,43,20,000/-, he informed to his relatI'VeS, Who advised him tO contact the Cybercrimes police. 3. Heard. __-`=-=| -=3 r _ \ 4. A perusal of the material on record goes to show that certain amounts have been deposI®ted into the account of the petitl'oner herein for whI'Ch he has no clue at all. The petjtjoner was arrested on o7.12.2024 and sI'nCe then, he is in judicial custody. 5. In view of the aforesaid facts and cI'rCumstances, thI®S Court I-S incll-ned to grant bail to the petjtjoner/accused No.2 hereI®n, On the following conditl-ons. (i) The petitioner/accused No.2 herein shall be released on h: executing a personal bond for Rs.25,000/- (Rupees Twenty Five Thousand only) each with two sureties for-a like sum each to the satisfaction of the learned Judicial Magistrate of First Class, Narsipatnam.
