JUSTICE BISWAJIT PALIT Order 30/03/2026 Learned Counsel Mr. Debesh Chandra Roy, is present on behalf of the petitioner and Learned GA Mr. Kohinoor N Bhattacharyya, is present on behalf of the respondents. At the time of hearing, Learned Counsel for the petitioner drawn the attention of the court that the petitioner has filed this writ petition seeking relief for financial benefits with retrospective effect in the post of Assistant Accounts Officer but in the prayer portion the petitioner has sought relief for releasing of service benefit like pension, gratuity, etc. which appears to be contradictory to the contention of the petitioner. Learned GA Mr. Kohinoor N Bhattacharyya, drawn the attention of the Court that from the judgment of the High Court it transpires that the petitioner was sleeping over the matter for a considerable long period of time and he did not take any steps and as such, no relief was granted. So this present petition is not maintainable. 2 At this stage, Learned Counsel for the petitioner has drawn the attention of the Court to allow the petitioner to withdraw the petition with a liberty to file a fresh petition seeking appropriate relief. Request is considered. Liberty is given to the petitioner to withdraw the petition and to file a fresh petition seeking appropriate relief to redress his grievances.
