1. Heard learned counsel for the petitioners and learned APP for the State. 2. The petitioners seek bail in anticipation of their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 307, 504 and 506 of the Indian Penal Code. 3. The learned counsel for the petitioners submits that the petitioner nos.1, 3 and 4 have antecedent of one case and

It is next submitted that from perusal of the allegation as alleged in the FIR, it would manifest that on account of dispute relating to land, the occurrence is alleged to have taken place and the petitioners and the informant are related. It is next submitted that the informant has implicated the entire family members. It is next submitted that Ramashish Rajbhar is alleged to have assaulted Ramashankar Rajbhar with an iron rod causing injury on head. Thereafter, Anil Rajbhar is alleged to have assaulted the informant by lathi from behind causing injury and the allegation against rest of the petitioners is general and omnibus in nature. 4.
It is further submitted that even the blow is not alleged to have been repeated. It is further submitted that criminal antecedent which the petitioners carry is on account of the fact that informant and his side instituted the aforesaid case as recorded at Para-3 of the anticipatory bail application. It is next submitted that petitioners are not criminals and in the event, if privilege of anticipatory bail is granted, the petitioners will cooperate in the investigation to prove their innocence. 5. Considering the submissions made by the learned counsel for the petitioners, the petitioners, above-named, in the event of their arrest or surrender before the learned Court below within a period of six weeks, are directed to be released on bail on their furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Buxar in connection with Buxar (Industrial) P. S. Case No.213 of 2023, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
