Revenue Code, 2006, were concluded by order of Tehsildar concerned against which a statutory appeal under Section 35(2) of U.P. Revenue Code, 2006 was filed before Sub Divisional Officer and the matter was remanded to court of Tehsildar concerned. According to learned counsel for petitioner, the matter is pending for long and same is not being decided. He further contends that file from the court of Tehsildar is missing. 3. As no useful purpose would be served in keeping the matter pending, the writ petition is being disposed of, at the admission stage, without calling for counter affidavit, with a direction upon respondent no. 3/Tehsildar, Tehsil-Karchhana, District-Prayagraj to proceed with Case No. 612 of 2001 post remand, after searching the file of same and decide the same positively within a period of two months from the date of production of certified copy of this order. 4. With the aforesaid directions, writ petition stands disposed of. 5. It is made clear that this Court has not adjudicated the matter on merits.
