Neutral Citation No. - 2025:AHC:104388 Court No. - 4 Case :- WRIT - A No. - 8686 of 2025 Petitioner :- Ramesh Chandra Respondent :- State Of U.P. And 4 Others Counsel for Petitioner :- Atipriya Gautam Counsel for Respondent :- C.S.C. Hon'ble Ajit Kumar,J. Heard Sri Vijay Gautam, learned Senior Advocate assisted by Ms. Atipriya Gautam, learned counsel for the petitioner and learned Standing Counsel. By means of present petition filed under Article 226 of the Constitution, petitioner has questioned the order of transfer dated 15.6.2025, whereby petitioner has been transferred from Prayagraj to Agra and one Surendra Kumar has been transferred from Agra to Prayagraj. Submission advanced by learned counsel for the petitioner is that petitioner was earlier transferred on his personal request from Kanpur to Prayagraj as his wife working as Headmistress in School at Prayagraj. Thus according to him he was transferred on personal request and submits that his wife is still discharging her duties as headmistress in school at Prayagraj. Per contra, learned Standing Counsel submits that the order of transfer has been assailed for two reasons; firstly the complaint; and secondly personal request and petitioner has not annexed any letter of personal request to support the contention that he was transferred to Prayagraj on personal ground. On pointed query being made, learned counsel for the petitioner admits that no such document has been appended, however, he submits that complaint was made by Surendra Kumar and in order to accommodate him petitioner has been transferred. Be that as it may, since petitioner has been transferred from Prayagraj to Agra as he is working on transferable post, I refuse to grant indulgence in the matter, however, it is provided that in the event petitioner makes representation within a period of two weeks from today, the same shall be look into considered and disposed of within a further period of four weeks by means of reasoned and speaking order. With the aforesaid observations and direction, this petition stands disposed of. Order Date :- 3.7.2025 Sanjeev Digitally signed by :- SANJEEV RANJAN High Court of Judicature at Allahabad
