Petitioner qualified physical eligibility test but ultimately was declared medically unfit due to Knock Knee problem and hence in both medical and review medical petitioner got declared unfit for these above reasons. The petitioner now has approached this Court for granting one more opportunity to undergo medical examination on the ground that petitioner was found fit in all general physical examination including knock knee conducted by the medical board for appointment on the post of Pointsmen (group-D) in Western Railway. Since the controversy involved in this review petition for the purpose of medical test for third time is no more res integra in the light of the judgment of this Court in the case of Miss Neha v. State of U.P. and others passed in Writ - A No.- 10905 of 2023 on 13th July, 2023, this petition is also consigned to records in terms of the judgment passed in Writ - A No.- 10905 of 2023 on 13th July, 2023.
