JUSTICE WASIM SADIQ NARGAL, JUDGE ORDER 03.09.2025 The instant contempt petition arising out of an order/judgment passed by this Court, by virtue of which, the writ petition preferred by the petitioner was disposed of with a direction to the respondents to decide the objections filed by the petitioner-Federation and its associate members to the rules mentioned within a period of four weeks from the date copy of the aforesaid order along with the writ petition and allied documents were made available to the said respondents. While parting with the aforesaid order/judgment, the learned writ Court has also directed that the respondents shall ensure that no transport vehicle is allowed to operate in violation of the Act and the rules framed thereunder. The decision taken by the respondent was directed to be communicated to the petitioner-federation within a week’s time thereafter. Since there is no representation on behalf of the petitioner, Mr. Ilayas Nazir Laway, learned GA, on asking of the Court, has caused appearance on behalf of the respondents, who assures this Court that the order/judgment passed by this Court shall be complied with in its letter and spirit within two weeks’ positively. In the light of the assurance extended by the learned counsel for the respondents, no fruitful purpose would be served to keep this contempt petition alive and, accordingly, the same is disposed of by directing the respondents to comply the order/judgment dated 13.03.2024, passed by this Court in its letter and spirit within two weeks. Proceedings in the instant contempt petition are closed accordingly. Rule, if any framed, shall stand discharged. However, it is made clear that in case the order/judgment mentioned (supra) is not complied with within the time granted by this Court, the petitioner is at liberty to revive the instant contempt petition and in that eventuality, this Court will be constrained to initiate coercive measures against the respondents.
