Side) ORDER Pursuant to the orders passed by this Court on 25.06.2025 and 23.07.2025, the petitioner has deposited a total sum of Rs.6,61,000/- to the credit of Cr.No.11 of 2023. The defacto- complainant is present today. Upon enquiry, he submitted that he has already instructed his counsel before the trial Court to file a petition to withdraw the said amount. However, when https://www.mhc.tn.gov.in/judis https://www.mhc.tn.gov.in/judis he was questioned with reference to paragraph 10 of the order dated 25.06.2025, wherein his withdrawal is subject to the condition that the defacto-complainant agrees to give quietus to the issue. For which, he neither gave the required assurance nor was he able to provide any answer. 2.The learned Government Advocate (Criminal side) appearing for the respondent submitted that in this case charge sheet has been filed in C.C.No.728 of 2025 on the file of learned Judicial Magistrate No.I, Kancheepuram. 3.In view of the above, it is made clear that, in the event the defacto-complainant agrees to give quietus by filing the proper petition before the investigating officer and the lower court, only then can he withdraw the amount. Until such time, the defacto-complainant shall not be permitted to withdraw the said sum. 4.Accordingly, the trial Court is directed to deposit the amount of Rs.6,61,000/- in an interest bearing fixed deposit account.
