ORDER:
The instant Writ Petition is filed by the Petitioner seeking indulgence of this Court under Article 226 of the Constitution of India for the following relief:
“ .... to issue a Writ, Order or Direction more particularly one in the nature of Writ of Mandamus declaring the a) inaction of Respondent No.2 and 3 in not registering the complaint of the petitioner as FIR. b) inaction of Respondent No.4 in not taking into cognizance as per Section 190(1)(a) and 200 of the CrPC as arbitrary, illegal, and violative of Articles 14, 21 of the Constitution of India and violative of the provisions of the Scheduled Castes and the Scheduled Tribes (Prevention Of Atrocities) Act, 1989 and consequently, to direct the Respondent No.4 to take the cognizance of the complaint given by the petitioner and pass ....”
2. Learned counsel for the Petitioner would submit that the Petitioner has filed a private complaint before the Court of Special Judge, for trial of Cases under SCs & STs (PoA) Act, 1989-cum-X Additional District and Sessions Judge, East Godavari District, Rajahmundry and the said complaint is pending for
consideration. Learned Counsel requested for a direction to the Trial Court to take an appropriate direction in the matter as expeditiously as possible.
3. Learned Assistant Government Pleader for Home, on instructions, would submit that the Court may pass appropriate orders.
4. Considering the submissions, it is apposite to direct the Trial Court to dispose of the private complaint filed by the Petitioner by taking appropriate decision over the matter as expeditiously as possible without granting any adjournment in a casual way by mere asking.
5. Accordingly, this Writ Petition is disposed of. No order as to costs. Pending applications, if any, shall stand closed.
