Sinha, A.P.P [B.A. 2257/2025] --- 03 / 03.04.2025 All these bail applications arise out of the same police case. As such, they are being disposed of by a common order. Heard the parties. 2. Petitioners have been made accused in connection with Giridih (Cyber) P.S. Case No. 45 of 2024 for the offences registered under sections 111(2), 318(4), 319(2), 336(3), 338, 340(2) and 3(5) of the Bharatiya Nyaya Sanhita, 2. 2023 and sections 66B 66C, and 66D of I.T. Act, pending in the court of learned Additional Sessions Judge-II-cum-Special Judge, Cyber Crime, Giridih. 3. On 30.12.2024, cyber police, Giridih on the basis of confidential information, raided a place near Mohanpur Forest and apprehended the petitioners along with the co-accused persons. On search, mobile phones and e- gadgets were recovered from their possession. 4. Learned A.P.P after going through the case diary, submitted that as far as the petitioners Md. Manir Ansari @ Manir Ansari, Md. Rauf Ansari @ Rauf Ansari and Md. Samim are concerned, police has not recorded statement of any victim to show that these petitioners have cheated anyone. It was further submitted that as far as the petitioner Afzal Ansari is concerned, police has recorded the statement of the victim which shows that the mobile phone which was recovered from his possession, was used in defrauding him. 5. In view of the submission made above, I am not inclined to enlarge the petitioner Afzal Ansari on bail. Accordingly, his prayer for bail stands rejected, at this stage. 6. However, I am inclined to enlarge the petitioners Md. Manir Ansari @ Manir Ansari, Md. Rauf Ansari @ Rauf Ansari and Md. Samim on bail. Accordingly, petitioners Md. Manir Ansari @ Manir Ansari, Md. Rauf Ansari @ Rauf Ansari and Md. Samim are directed to be released on bail on furnishing bail bonds of Rs. 20,000/- (Rupees twenty thousand) each, with two sureties of the like amount each, to the satisfaction of learned Additional Sessions Judge- II-cum-Special Judge, Cyber Crime, Giridih in connection with Giridih (Cyber) P.S.
