Mr. Ashish Kumar Nagvanshi, learned Standing Counsel for the State has filed personal affidavits along with exemption applications of respondent nos.2 and 3 in the Court today, which is taken on record. Heard Mr. Bhanu Prakash Gupta, learned counsel for the petitioner as well as Mr. Ashish Kumar Nagvanshi, learned Standing Counsel for the State and perused the record. The present petition has been filed with the following prayers :- "(i) to issue a writ, order or direction in the nature of certiorari quashing the impugned order/letter dated 6.6.2025 as well as dated 31.6.2025 [advance and wrong date] [filed as Annexure No.1 to this Writ Petition] passed by Respondent No.3 i.e. Finance and Account Officer, Basic Education Moradabad. (ii) to issue a writ, order or direction in the nature of mandamus commanding and directing the Finance and Account Officer, [Basic Education] Moradabad as well as Respondent No.4 i.e. Manager- Janta Junior High School, Village Laungi Kalan, Thakurdwara, District Moradabad to release the deducted salary for the month of May, 2025 with restoring the pay fixation letter dated 26.11.2013 as well as 1.2.2016 and direct the Respondents to release the salary of June 2025 in pursuance of the aforesaid pay fixation letter dated 26.11.2013 as well as 1.2.2016 passed by Respondent No.3 in favour of the Petitioner, in view of judgment dated 4.4.2025 as well as judgment and order dated 2.5.2022 of the Hon'ble Supreme Court." The earlier order which was passed due to mistake on the part of the Management in not sending the papers so that pay fixation could be done, has already been withdrawn by the respondent authorities after constituting the Committee and calculating accordingly. The impugned order/letter dated 6.6.2025 has been withdrawn. Learned counsel for the petitioner submits that the present petition has become infructuous. Accordingly, the present petition is dismissed as infructuous. The personal presence of respondent nos.2 and 3 is exempted.
