On the matter being taken up, learned A.G.A. representing the State pointed out that in para 25 of the bail application, it is mentioned that the applicant has no criminal history. On previous occasion, when it was pointed out that the applicant has criminal history then the applicant filed supplementary affidavit dated 13.07.2025 disclosing that he has criminal history of three cases being Case Crime No. 0153 of 2022, under Sections 506, 504, 323 IPC, Police Station Hanumanganj, District Kushinagar, Case Crime No. 0088 of 2024, under Sections 323, 504, 506 IPC, Police Station Hanumanganj, District Kushinagar and Case Crime No. 0074 of 2022, under Sections 419, 420, 467, 468 (wrongly mentioned as 458), 471, 120B IPC, Police Station Vishunpura, District Kushinagar but did not disclose the present status thereof. In response, learned counsel for the applicants submits that the applicants may be permitted to withdraw this bail application with liberty to file fresh bail application with better particulars. Learned A.G.A. representing the State has no objection to such prayer of learned counsel for the applicant. In view of the above, the instant bail application is dismissed as withdrawn/not pressed with liberty as prayed for. Office is directed to return certified copy of the documents, if any, after retaining the xerox copy of the same on record, to learned counsel for the applicants within three days. It is made clear that since the instant bail application has not been decided on merit, hence in case the fresh bail application is moved, the same shall not be treated as tied-up or part-heard to this Bench.
