1. The writ petition came to be filed on 17th April, 2025 whereby twelve (12) petitioners came forward seeking inherent jurisdiction of this Court for quashment of an FIR No.28/ 2025 dated 22.02.2025 registered by the Police Station Magam.
2. This FIR has been registered at the instance of the respondent No.3-Waseem Ahmad Bhat who is said to be brother of the petitioners No. 1 to 5 and the petitioners No. 6 to 12 are the near relatives.
3. The allegations in the FIR are said to have been motivated with personal malice.
4. At the time when this petition came to be filed, the said FIR had not seen the closure of investigation but today when this case has come up for its first hearing, it is being conveyed by Mr. Bikramdeep Singh, learned Dy. AG that on the very next date of filing of this petition, final police report came to be submitted booking all the twelve petitioners as accused out of which, except for the petitioner No.3, all the petitioners came to be presented as accused and all of them are on bail except the petitioner No.3 who was not presented before the Court along with challan.

Mr. Sajad Ashraf, learned Advocate for the petitioners submits that because of change of circumstances he is left with no other option but to withdraw this petition so as to throw challenge to final police report but seeking indulgence of this Court to protect the petitioner No. 3-Gulzar Ahmad Bhat who is said to be a Government Servant which is not possible as the petition is to fail as infructuous.
6. This petition is allowed to be withdrawn by learned counsel for the petitioners with liberty to file fresh one for throwing challenge to the final outcome of FIR No.28/ 2025 dated 22.02.2025 registered by the Police Station Magam.
7. Dismissed as withdrawn in terms of the above.
