Bhaskar Rao ...PETITIONER AND APSRTC and 2 others ...RESPONDENTS Counsel for the Petitioner: None Counsel for the Respondents: 1.Mr. Vinod Kumar Tarlada (SC for APSRTC) The Court made the following ORDER: The writ petitioner instituted the instant Writ Petition seeking the following relief: “ ….. to issue an order, direction or writ particularly one in the nature of writ of Mandamus or any other appropriate writ (i) declaring the action of the respondents in not providing alternate employment in any suitable post as per Section 47 of Persons with Disabilities (Equal Opportunity, Protection of Rights and Full Participation) Act, 1995 (Act 1 of 1996) as illegal, arbitrary and unjust; (ii) and consequently direct the respondents to provide alternate employment to the petitioner Section 47 of Persons with Disabilities (Equal Opportunity, Protection of Rights and Full Participation) Act, 1995 (Act 1 of 2 MRK, J W.P.No.28858 of 2009 1996) and release all the consequential benefits to which the petitioner is entitled to (iii) and pass….” 2. On 21.04.2010, this Court, in W.P.M.P.No.37506 of 2009, pleased to grant interim direction whereby directed the respondents to consider the case of the petitioner for providing alternative employment in any suitable post as per the provisions of Section 47 of the Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act, 1995. 3. Therefore, the case was adjourned from time to time and lastly listed on 31.01.2025 and, on the said date, there is no representation for the petitioner. 4. Today, when the matter is listed for hearing, Mr. Vinod Kumar Tarlada, learned Standing Counsel for the respondent Corporation, on instructions, submitted that, consequent to the interim order, dated 21.04.2010, passed in W.P.M.P.No.37506 of 2009, the respondent authorities provided an alternative employment to the petitioner as Shramik. The date of birth of the petitioner is 07.12.1957 and he was retired on 31.12.2015 and his retirement benefits were also settled by the respondent Corporation. 5. In view of the above submission made by learned Standing Counsel for the respondent Corporation coupled with the fact that there is no representation from the side of the petitioner on 31.01.2025 as well as today despite the matter being listed under the caption, ‘for dismissal’, this Writ 3 MRK, J W.P.No.28858 of 2009 Petition is closed as no further orders are necessary. There shall be no order as to costs.
