In this writ petition, the petitioner-Mutt is seeking direction to the respondent No.3 to consider the application dated 28th August, 2023 (Annexure-A) filed by the petitioner under Section 151 of the Civil Procedure Code. 3. Heard Sri. Udaya Prakash, learned counsel appearing for the petitioner and Sri. Mahantesh Shettar, learned Additional Government Advocate appearing for respondents 1 to 3. 4. Having heard the learned counsel appearing for the parties and taking into consideration the fact that the application filed by the petitioner herein under Section 151 of the Civil Procedure Code is pending consideration before the competent authority for more than two years, I am of the view that, there is no impediment for the respondent No.3 to consider the said application at the earliest. Therefore, without expressing any opinion on merits of the case, the respondent No.3 is directed to consider the application dated 28th August, 2023 (Annexure-A) filed by the petitioner herein within an outer limit of six months from the date of receipt of this order. - 4 - HC-KAR NC: 2025:KHC:39772 WP NO.23598 OF 2023 5.
