Sri Byas Kumar Prasad, Advocate appears and submits that the accused/applicant has been falsely implicated in Case Crime No. 64 of 2025, under Section 2/3 Gangster Act, Police Station Khergarh, District Agra. 2. Learned counsel contends that there are six base cases in the gang chart and in all the six cases, applicant is on bail. He is also on bail in other cases shown as criminal history. As such, he prays that the accused/applicant be enlarged on bail. 3. The prayer for bail has been vehemently opposed by learned A.G.A. However he does not dispute the fact that the applicant has been granted bail in all the cases mentioned against him in the gang chart and as criminal history. 4. This Court has taken into consideration the rival submissions made by the parties and perused the record. 5. The record prima facie reveals that six base cases have been mentioned in the gang chart, wherein the accused is on bail and is also on bail in other cases of criminal history. All the cases shown in the gang chart and criminal history are either the police case or the FIR have been lodged against anonymous persons. The applicant is in jail since May, 2025. 6. Without touching the merit of the case, this Court is of the opinion that this bail application is allowed. 7. Let the accused applicant Shiv Kumar Alias Sonu be enlarged on bail subject to furnishing a personal bond and two sureties each in the like amount to the satisfaction of the court concerned.
