Neutral Citation No. - 2025:AHC:131845-DB Court No. - 46 Case :- CRIMINAL MISC. WRIT PETITION No. - 13806 of 2025 Petitioner :- Hema Lal Respondent :- State Of Uttar Pradesh And 7 Others Counsel for Petitioner :- Aishwarya Pratap Singh Counsel for Respondent :- Imran Ullah,G.A. Hon'ble Rajiv Gupta,J. Hon'ble Harvir Singh,J. 1. Heard Sri Aishwarya Pratap Singh, learned counsel for the petitioner, Sri Imran Ullah, learned counsel for respondent Nos. 3,4,5 and 6 and learned A.G.A. for the State. Perused the record. 2. At the very outset learned counsel for respondent Nos. 3,4, 5 and 6 has pointed out that against the impugned order dated 6.3.2025, the petitioner has efficacious and expeditious remedy under Section 101 of the Juvenile Justice (Care and Protection of Children) Act, 2015 by preferring an appeal against the aforesaid impugned judgment and order. It has been further pointed out that even a petition under the Guardian and Wards Act has been preferred before the competent court wherein the parties are contesting. 3. The aforesaid facts have not been disputed by any of the parties. 4. In view thereof, we are of the view that the petitioner having an efficacious and expeditious remedy before the appellate court to prefer an appeal, the present petition is disposed of on the ground of alternative remedy. 5. However, it is made clear that the appeal filed by the petitioner be decided on its own merit, condoning the delay, if any.
