2. The petitioner seeks regular bail in connection with Excise P.S. Pupri Case No. 214 of 2025 for the offences registered under Sections 30(a), 32(C) of the Bihar Prohibition & Excise Act.
3. On secret information regarding transportation of illicit liquor in a TATA Magic vehicle, police party intercepted the said vehicle in which petitioner along with co-accused were sitting. On search of the said vehicle, total 198 liters of illicit liquor was recovered. Petitioner was apprehended on the spot.
4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case. Petitioner is neither owner nor driver of the said vehicle. He has no concern with the seized liquor. Petitioner was only
Patna High Court CR. MISC. No.57958 of 2025(3) dt.10-10-2025 2/2 passerby. There is no independent witness to the seizure-list. Petitioner has one criminal antecedent in which he is on bail. He is in judicial custody since 05.07.2025. Charge-sheet has already been submitted in this case. There is no chance of absconding the petitioner or tampering with the evidence.
5. Learned counsel appearing on behalf of the State opposes the prayer for grant of bail to the petitioner.

Considering the submissions made on behalf of the parties, facts and circumstances of the case and period of custody, let the petitioner, named above, be enlarged on bail upon furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Exclusive Excise, Court No.- II, Sitamarhi in connection with Excise P.S. Pupri Case No. 214 of 2025.
