Jamir Miya (In BLAPL No.1586 of 2025) Sadre Alam
(In BLAPL No.1596 of 2025) … Petitioners
Mr. S.K. Tripathy, Advocate
(for both the petitioners)
-versus- State of Odisha … Opposite Party Mr. R.B. Mishra, Addl. PP
CORAM:
JUSTICE G. SATAPATHY
Order No.
ORDER(ORAL) 28.10.2025
04.
1. This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode).
2. Since these two bail applications arise out of one and same case record, the same are taken up together and disposed of by this common order with the consent of the learned counsel for the parties.
3. These are the bail applications U/S.483 of BNSS by the petitioners for grant of bail in connection with Mathili PS Case No.257 of 2024 corresponding to Special GR Case No.185 of 2024 pending in the file of learned Sessions Judge-Cum-Special Judge, Malkangiri, for commission of offences punishable U/Ss.20(b)(ii)(C) of NDPS Act, on the main allegation of transporting 107Kgs 300Grams of Contraband Ganja in a Skoda Car bearing Regd. No.CG-15CV-3171.
4. Heard, Mr. Soumyakanta Tripathy, learned counsel for both the petitioners and Mr. R.B. Mishra, learned Additional Public Prosecutor in the matter and perused the record.
5. After having considered the rival submissions and taking into account the nature and gravity of offences as alleged against the petitioners vis-à-vis the allegation sought to be brought against them and regard being had to the seizure of 107Kgs 300Grams of Contraband Ganja from the vehicle allegedly in occupation of the petitioners and their consequent failure to satisfy the conditions of Section 37 of NDPS Act, this Court is not inclined to grant bail to the petitioners at this stage, especially when the trial is yet to begin.
6. Hence, the bail applications of the petitioners Jamir Miya and Sadre Alam stand rejected. The petitioners may renew their prayer for bail, if the trial is not commenced within six months hence.
7. Accordingly, BLAPL Nos.1586 & 1596 of 2025 stand disposed of. Issue urgent certified copy of the
order as per Rules. A copy of this order be immediately transmitted to the concerned Court.
