1. Heard learned counsel for the petitioners and learned APP for the State. 2. The petitioners seek bail in anticipation of their arrest in a case registered for the offences punishable under Sections 329(4), 115(2), 109, 333, 76, 303, 3(5) of the Indian Penal Code. 3. The learned counsel for the petitioners submits that the petitioners are persons with clean antecedent and the informant alleges that Lalan and Ranjeet entered her house and acted inappropriately with her daughter in-law. On alarm, they fled, but returned with the named accused persons including the petitioners along with three unknown accused and thereafter, the

No.58677 of 2025(2) dt.08-09-2025 2/3 accused persons touched her daughter in-law inappropriately and disrobed the informant and assaulted by feets and shoes causing injury on nose, ear and mouth. Thereafter, Lalan, Ranjeet and petitioners assaulted Ravindra and Vikash by pistol, rod and lathi causing injury on head of Ravindra. Further, Kartik, Ranjan and Bihu assaulted her son Vikash by rod and lathi causing injury on head, while Raja and Aakash on orders of Jai Narayan took away Rs.35,000/- along with silver ornaments. 4. The learned counsel for the petitioners submits that petitioners have been falsely implicated in the instant case by the informant. It is next submitted that from perusal of the allegation as alleged in the FIR, it would manifest that informant alleges that Lalan, Ranjeet and petitioners assaulted Ravindra and Vikash by pistol, rod and lathi causing injury on head of Ravindra, but then, the injury suffered by Ravindra has been opined to be simple. It is also submitted that even allegation of assault is not specific rather petitioners along with two others are alleged to have assaulted Ravindra and Vikash.
It is next submitted that had the Ravindra been assaulted in the manner as alleged in the FIR, in that event, the injury would not have been opined to be simple. 5. Learned A.P.P. opposes the anticipatory bail application. 6. Considering the submissions made by the learned counsel for the petitioners, the petitioners, above-named, in the event of their arrest or surrender before the learned Court below within a period of six weeks, are directed to be released on anticipatory bail on their furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Saran at Chapra in connection with Amanaur P. S. Case No.351 of 2024, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
