The detenu-K.S.Raghavendra (CTP No.14153) is before this Court seeking for the following reliefs: a. To Issue writ in the nature of certiorari to quash the order dated 20.10.2025 passed by the R2 in no. CPB/CTP-SEC/14312/2025 vide Annx-A and consequently direct the r2 to release the petitioner on general parole for a period of 90 days to repair his house and assist his old parents in the interest of justice and equity. b. Call for records if necessary for the records in respect of the schedule property from the file of the respondents. c. Issue such other orders as this Hon'ble Court deems fit to grant in the facts and circumstances of the case including an order as to the costs of the present writ petition. 2. The detenu had been convicted in Spl.C.C.No.15/2023 for offences under Section 376(2)(n) and 376(3) of the IPC & 506 of IPC & u/s 5(j), 5(1), 5(p) and 6 of POCSO Act, 2012 by the Additional City Civil and Sessions Judge Court, FTSC- 3, Bengaluru City and sentenced on 06.01.2024 with the highest of the sentence being imprisonment for - 3 - HC-KAR NC: 2025:KHC:53254 WP No. 35416 of 2025 life. The detenu has served a period of 02 years 11 months 04 days of imprisonment as on 03.11.2025. 3. Considering the gravity of the offences more particularly i.e., under Section 376(2)(n) and 376 (3) R/w Section 5(j), 5(1), 5(p) and 6 of POCSO Act, 2012. The detenu having served only 02 years 11 months 04 days of incarceration, the detenu could be danger to the victim, I am of the considered opinion that the prayer for parole cannot be considered for now.
