The present bail application has been moved by the applicant-accused Monu Chauhan for the offence punishable under Sections 109(1), 3(5) B.N.S., 3, 25, 27(1) of Arms Act, in Case Crime No. 11 of 2025, Police Station- Sakrar, District Jhansi. 2. Mr. Uttam Singh, learned advocate, appears on behalf of applicant and submits that accused-applicant has been falsely implicated in the present case. He further submits that this is a no injury case. The accused-applicant has neither arrested from the spot nor any incriminating material has been recovered from his possession. It is further contended that the no specific role has been attributed to the accused-applicant. The accused-applicant is in jail since 24.01.2025. 3. Per contra, learned AGA has opposed the prayer for bail and submits that the charge sheet has been submitted against the accused-applicant. 4. Taken into consideration the rival submissions made by the parties and perused the record. 5. The perusal of the record reveals that the accused-applicant has been apprehended by the police. The entire process of arrest and recovery has been made in absence of independent witness. The accused-applicant himself suffered gun shot injury. The criminal history of 20 cases has been explained by the accused- applicant and in all the cases he is on bail. The charge sheet is submitted. The accused-applicant is in jail since 24.01.2025. Without touching the merit of the case, this bail application is allowed. 6. Let the accused applicant be enlarged on bail subject to furnishing a personal bond and two sureties each in the like amount to the satisfaction of the court concerned.
