1. Status Report has been handed over during the course of the proceedings, the same is taken on record.
2. Applicant seeks anticipatory bail in e-FIR No.80042067/2025 under Sections 305/331(3) of Bharatiya Nyaya Sanhita (BNS), 2023, (corresponding Sections 380/454 IPC) registered at P.S. Sarai Rohilla/e-Police Station.
3. The abovesaid e-FIR was registered on the basis of complaint of one Mr. Hari Om who claimed that, when he had gone to market with his wife, on his return, he noticed that the lock of the house was broken and some unknown person had committed theft of one gold chain, two gold rings, one silver bichia and cash amount of Rs.15,000/-.
4. Based on CCTV footage available with the investigating agency, one Monu was apprehended by the police, who, in his first disclosure statement, claimed that he had sold one such stolen gold ring to one Jeweller for Rs.22,000/- and the cash amount received in lieu of such sale was handed over to his sister-Sunita i.e. applicant herein.

Bench on 03.07.2025, this Court had directed that no coercive action be taken against the applicant, subject to her joining the investigation and cooperating with the Investigating Officer, on due notice.
6. Despite the fact that the abovesaid order was passed by this Court way back on 03.07.2025, surprisingly, no notice has so far been issued to her to join the investigation. It, therefore, appears that she is not required for any kind of custodial interrogation.
7. Keeping in mind the overall facts of the case, and the fact that the main offender-Monu, who had allegedly committed the abovesaid theft and who alone is visible in the CCTV footage has already been arrested, and the fact that no notice has so far been served upon the applicant and her involvement emanates from disclosure of her co-accused only, the present application is
disposed of by making the abovesaid order dated 03.07.2025 absolute and, accordingly, it is directed that the applicant shall keep on assisting the investigation and in the event of her arrest, she will be admitted to bail on her furnishing personal bond and surety bond in a sum of Rs.10,000/- subject to the satisfaction of the concerned arresting officer/SHO/IO.
