ORAL ORDER
1. The petitioner- daughter of detenu Suresh @ Suri @ ole @ Loose Maada (CTP No.4420) is before this Court seeking for the following reliefs: (a) Set aside the endorsement letter issued R3 bearing No. CPB/CTP-Sec/22318/2025 dated 17/Mar/2025, i.e. ‘Annexure-C’ and issue a writ order or direction in the nature of mandamus to the respondents to grant General parole of 90 days to the petitioner.
(b) Pass such other order/s, direction/s considering the
facts and circumstances of the case, together with costs in the interest of justice.
2. The detenu had been convicted in S.C.No.34/2008 for offences under Section 396 of IPC by the District and Sessions Judge, Ramanagara and sentenced on 30.03.2011 for a period not less than 20 years. The detenu had earlier made an application for general parole which had been granted and detenu had availed parole for a period of 2 months 29 days. The detenu has served a period of 17 years 3 months 3 days of imprisonment as on
21.03.2025. An application having been made by the detenu for

parole on account of house repair, same came to be rejected on the ground of pending proceedings.

Learned counsel for the petitioner submits that in the said pending proceeding, the detenu has pleaded guilty and the matter is no longer pending. In that regard, order in CC No.8399/2021 is produced at Annexure-D to the petition.
4. In that view of the matter, the reason for rejection of parole of the petitioner being pendency of another criminal proceedings does not exist in law. As such, I pass the following:
ORDER i) The Writ Petition is allowed. ii) Respondent–Chief Superintendent, Central Prison, Bangalore, is directed to release the detenu- Suresh @ Suri @ ole @ Loose Maada (CTP No.4420) on parole for a period of 60 days commencing from 17.11.2025 or from the date

of release, whichever is earlier, subject to the following conditions: a) The prisoner- Suresh @ Suri @ ole @ Loose Maada (CTP No.4420) shall mark his attendance in the jurisdictional Police Station, weekly once throughout the period of his parole and it would be the responsibility of the jurisdictional Police to take them to gaol, in the event, the convict would evade going back to the gaol, after the expiry of the period of parole. b) Respondent No.1- State of Karnataka shall stipulate strict conditions as are usually stipulated to ensure return of the detenu to the gaol and that he shall not commit any other offence during the period of parole. iii) The Registry is directed to communicate the
order to the prison authority for its immediate execution.
