(ORAL) Through the instant petition filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (For short “BNSS”), the petitioner seeks anticipatory bail in case FIR No.94 dated 27.04.2025 under Sections 406, 420-B and 120-B IPC, registered at Police Station Civil Lines Patiala, District Patiala.

Learned counsel for the petitioner submits that in compliance of the order dated 16.06.2025 passed by this Court, the petitioner has joined the investigation.
3. On 16.06.2025, following order had been passed: -
“ Apprehending their arrest in FIR No.94, dated 27.04.2025, registered for offences punishable under Sections 406, 420-B and 120-B of the Indian Penal Code, 1860, at Police Station Civil Lines Patiala, District Patiala, the petitioners have preferred this petition under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023, seeking pre-arrest bail. CRM-M-32466-2025 -2- Issue notice of motion, returnable for 02.09.2025. Mr. Akhil Kamra, AAG, Punjab appears and accepts notice on behalf of the respondent/State. Mr. A.B.S. Sandhu, Advocate appears and files his power of attorney on behalf of the complainant today in Court, which is taken on record. Ld. Counsel for the petitioners inter alia contends that the allegations w.r.t. cheating cannot be sustained in view of the fact that after marriage, boy indeed and admittedly joined girl and lived with her in a matrimonial alliance in Canada for more than 4 months. However, owing to their differences in Canada, the couple fell apart. The aforesaid fact is not disputed by counsel for the complainant. In the meantime, in the event of arrest, the petitioners shall be released on interim bail subject to their furnishing personal and surety bonds to the satisfaction of the Arresting Officer/Investigating Officer. As and when called, the petitioners shall join the investigation. They shall abide by the conditions enumerated under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023.”

Learned counsel for the State, on instructions from ASI Bharat Bhushan, has submitted that the petitioner has joined the investigation and is no longer required for further investigation.
5. In view of the statement made by learned State counsel, the interim order dated 16.06.2025 is made absolute. The petitioner shall continue to join investigation, as and when called by the Investigating Officer and shall also abide by the conditions as provided under Section 482(2) of the BNSS.
