(351 of the BNSS, 2023), in respect of the chief examination of the complainant conducted on 07.01.2025, subsequent to framing of altered charge. 2. In view of the limited prayer, the notice to respondent is dispensed with. 3. The trial is pending on the file of I Additional Chief Metropolitan Magistrate, Bengaluru in C.C.No.25584/2018, for the offence Punishable under Section 417, 420 and 506(B) of IPC. 4. The altered charge was framed on 22.01.2024, consequent to which, the petitioner / complainant’s further evidence was recorded on 07.01.2025. The grievance of the petitioner is that on the said further examination, the learned Magistrate ought to have recorded the further statement of the accused as required under law, since incriminating evidence do exist. 6. Considering the additional evidence given by petitioner / complainant, on 07.01.2025, (Annexure F), the learned Magistrate is directed to record the statement of the accused under Section 351 of the BNSS, 2023 (313 of Cr.P.C.) and proceed further, in accordance with law. 8.
