It is the case of the petitioner that initial amount payable by 10-01-2025 in terms of Ext.P1 judgment was Rs.4,00,000/- and that was paid on 13-01-2025, as can be seen from Ext.P2. It is submitted that the petitioner could not pay the instalments payable on 10-02-2025 and 10-03-2025 and presently the Advocate Commissioner has issued notice for taking physical possession of the secured asset. It is submitted that the petitioner will pay off the defaulted instalments within a period of one week from today. 2. Heard the learned counsel for the respondent bank also. 3. Having heard the learned counsel for the petitioner and the learned counsel for the respondent bank and considering the facts and circumstances of the case noticed above and though this writ petition is technically not maintainable, purely as a matter of indulgence, this writ petition will stand disposed of directing that if the instalments payable by the petitioner on 10-02-2025 and 10-03-2025 in terms of Ext.P1 are paid within a period of one week from today (07-04-2025), the petitioner will continue to enjoy the benefit of Ext.P1 judgment.
