This application under Section 529 Bhartiya Nagrik Suraksha Sanhita (hereinafter referred to as B.N.S.S.) has been filed with a prayer to direct the learned trial court to decide the proceeding of Case No. 2350 of 2013 (State Vs. Smt. Reeta Devi and others), relating to case Crime No. 515 of 2012, under Sections 419, 420, 467, 468 I.P.C., Police Station Sarai Akil, District Kaushambi, pending before the learned Additional Civil Judge (Senior Division), Kaushambi, expeditiously within a stipulated period. 2. Heard learned counsel for the applicant as well as learned A.G.A. for the State. 3. It is submitted by the learned counsel for the applicant that the applicant before this Court is informant. The matter is very old pending since the year 2013. It is further submitted that charges were framed and after framing of the charges, several dates were fixed for recording of evidence. It is next submitted that since the accused persons are not appearing, trial is lingering on unnecessarily. 4. Learned AGA opposed the prayer. 5. I have considered the submissions and perused the record. From perusal of the order sheet, it appears that charges were framed and after framing of the charges, several dates were fixed for recording of evidence, even the applicant is also not appearing before the court for recording of his evidence. However, subsequently after some time the accused persons appeared before the court and one of the accused Chhaya Devi expired and the court summoned her death report. 6. In the facts and circumstances of the case and taking view of the fact that since the delay was caused in disposal of the matter by the applicant himself, I do not find any ground to pass any direction to the trial court. 7.
