CRM-M-32380-2025 (O&M) -2- hand got fractured. Accordingly, the FIR in question was registered against him.
Learned counsel for the petitioner contended that the false and frivolous allegations have been levelled against the petitioner. The petitioner was not the registered owner of the vehicle allegedly used in the crime. Rather the complainant was intoxicated and under influence of liquor and he had received injuries while falling down from the motorcycle. He urged that no specific injury has been attributed to the petitioner. Several criminal cases are also registered against the complainant. There is unexplained delay of 2 days in registration of the FIR and this time was consumed to concoct the false story to falsely implicate the petitioner in the present case. The petitioner is in custody since 06.04.2025. He has urged that as trial of the case is likely to take time, therefore, the petitioner be granted concession of regular bail. Learned State counsel has opposed the petition and submitted that the petitioner intentionally hit the motorcycle of the complainant and his car and later on along with other co-accused inflicted serious injuries on person of the complainant and as such he is not entitled to the concession of regular bail. Heard. As per the allegations, the petitioner hit his car into the motorcycle of the complainant and when he fell down then the petitioner along with other co-accused inflicted injuries on his person with wooden sticks and iron rod. No specific injury has been attributed to the petitioner and no such injury has been pointed that had been caused to the petitioner due to hiting of car by the petitioner into the motorcycle of the complainant. CRM-M-32380-2025 (O&M) -3- As per status report, several other criminal cases had been registered against the petitioner but as per the detail given in para No.18 of the status report, in most of these cases, the petitioner has already been acquitted. As per the custody certificate, the petitioner is in custody since 04 months and 21 days. Challan has already been presented in this case and trial is going on. As conclusion of trial is likely to take time, so no useful purpose would be served by further detaining the petitioner behind the bars.
Accordingly, the present petition is allowed and the petitioner is ordered to be admitted to regular bail, on furnishing adequate bail bonds and surety bonds, to the satisfaction of concerned learned trial Judge/Chief Judicial Magistrate/Duty Magistrate. However, nothing observed herein above shall be construed to be an expression of opinion on the merits of the case. The observations recorded above are only for the purpose of deciding the present bail petition. (SUKHVINDER KAUR) JUDGE
