ORAL ORDER This petition is filed by accused No.2 under Section 483 of the Bharatiya Nagarik Suraksha Sanhitha, 2023 praying to grant bail in Crime No.168/2025 of Chamarajanagar Town Police Station registered for the offence punishable under Section 303(2) of IPC. 2. Heard the learned counsel for petitioner and the learned High Court Government Pleader for respondent/ State
3. The learned counsel for the petitioner would contend that, the theft of car has taken place between 27.08.2025 and 28.08.2025, and complaint has been filed on 30.08.2025. The car has been secured on 08.09.2025

and it is near to the house of the complainant may be situated at a distance of 5 kilometres. The petitioner is a resident of Tamil Nadu, and he is involved in only one case of committing theft of a car. The investigation is almost over. With this, he prayed to allow the petition. 4. Per contra, the learned High Court Government Pleader for respondent/State would contend that, the petitioner is a habitual offender involved in Crime No.144/2025 of Chamarajanagara Town Police Station for committing offence under Section 303(2) of BNS, 2023. The investigation is in progress. The petitioner is a resident of Tamil Nadu. If he is granted bail, there are chances of committing similar offence, and flee from justice. With this, he prayed for rejection of the petition. 5. Having heard the learned counsel, the Court has perused the FIR, complaint and other materials placed on record. - 4 -

6. A complaint has been filed regarding theft of Maruti 800 car bearing No.KA-03-MA-7855 and kept in front of the house of complainant during the night between 27.08.2025 and 28.08.2025. The petitioner and the accused No.1 were found driving the said car on 08.09.2025, and they were interrogated and car was seized. The petitioner/accused No.2 and accused No.1 were arrested. The petitioner/accused No.2 along with accused No.1 is stated to be involved in Crime No.144/2025 of Chamarajanagar Town Police Station for having committed offence under Section 303(2) of BNS,
2023. The accused No.1 is also involved in another case in Crime No.166/2025 for offence under Section 303(2) of BNS, 2023. Both petitioner/accused No.2 and accused No.1 are residents of Tamil Nadu. The investigation is in progress.
The petitioner and accused No.1 are having criminal antecedents. As the investigation is in progress, if the petitioner is granted bail, there are chances of

hampering the investigation and tampering the prosecution witnesses and flee from justice. 7. Considering the above aspects, the petitioner has not made out a case for grant of bail at this stage when investigation is in progress. In the result, the following:
ORDER
The petition is dismissed.
