For Petitioner(s): Mr.T.Gandhi For Respondent(s): Mr.S.Prabhakaran, Govt.Advocate For R1 & R2 Mr.C.Jayaprakash, Govt.Advocate For R3 ORDER The writ petition has been filed to direct the 3 rd respondent to disburse the monetary benefits of the petitioner's deceased father, Ganapathi, including Gratuity, Earned Leave Benefits, pensions and all other services benefits from the date of retirement on 31.05.1988 with interest at the rate of 18% per annum in view of judgement dated 14.03.2022 passed in C.M.A.No.1 of 1988 on the file of Additional Subordinate Judge at Vellore. 2. The learned counsel for the petitioner would submit that the petitioner's father worked as a Head Master in the 3 rd respondent School. However, he was terminated from service vide order dated 13.06.1986. Subsequently, in the Page No.2 of 6 https://www.mhc.tn.gov.in/judis WP No. 23288 of 2025 appeal in CMA.No.1 of 1988 dated 14.03.2022, the order of termination was set aside. Meanwhile, during the pendency of the said appeal, the father of the petitioner died intestate, leaving behind the petitioner and other legal heirs. Hence, it is the submission of the petitioner that he is entitled to receive all the terminal benefits of his father. In this connection, the petitioner has taken steps by sending a representation on 19.08.2024 followed by a legal notice on 22.04.2025. Despite these efforts taken by the petitioner, the representation and notice are yet to be considered by the respondents. 3. At this juncture, the learned Government Advocate appearing on behalf of the respondents would submit that if the proposal is received from the authorities, they would consider the same in accordance with law. 4. In such view of the matter, without going into the merits of the writ petition, this Court deems it appropriate to direct the respondents to consider the petitioner's representation dated 19.08.2024 and the legal notice dated 22.04.2025 and pass orders within a period of eight (8) weeks from the date of Page No.3 of 6 https://www.mhc.tn.gov.in/judis WP No. 23288 of 2025 receipt of a copy of this order, based on its own merits and in accordance with law. 5. With the above directions, this Writ Petition stands disposed of.
