[2025:RJ-JP:8908] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No. 2183/2025 Shubham Singla S/o Naresh Kumar Singla, Aged About 22 Years, R/o A-1122, Gd Colony, Mayur Vihar, Phase-3, P.s Ghazipur East Delhi (At Present In District Jail Jaipur) ----Petitioner Versus State Of Rajasthan, Through PP ----Respondent For Petitioner(s) : Ms. Ginni Jain For Respondent(s) : Mr. S.R. Dhakar, PP HON'BLE MR. JUSTICE PRAVEER BHATNAGAR Order 28/02/2025 1. The instant bail application has been filed under Section 483 BNSS on behalf of accused-petitioner. The petitioner has been arrested in connection with FIR No.164/2024 registered at Police Station Sindhi Camp, District Jaipur (West) for the offence(s) under Sections 69, 81 and 351(2) of BNS. 2. Learned counsel for the accused-petitioner submits that the accused-petitioner has falsely been implicated in this case. It is alleged against the accused-petitioner that on the pretext of marriage, he established consensual relationship with the prosecutrix and thereafter, refused to register the marriage. It is also contended that the age of the prosecutrix is 37 years and that of accused-petitioner is 22 years. The accused-petitioner and prosecutrix were in consensual relationship and the accused- petitioner has not deceited the prosecutrix. The relationship [2025:RJ-JP:8908] (2 of 3) [CRLMB-2183/2025] between the prosecutrix and the accused-petitioner became sour and therefore, the said FIR has been lodged against the present petitioner. The accused-petitioner is in custody since long and trial of the case may take considerable time, therefore, the bail application of the accused-petitioner may be allowed. 3. Learned Public Prosecutor has vehemently opposed the bail application. 4. Heard and perused the material available on record. 5. It is alleged against the accused-petitioner that in the pretext of marriage, the accused-petitioner established relationship with the prosecutrix. It is stated in the complaint that the accused-petitioner and the prosecutrix were in consensual relationship. Whether the accused-petitioner has cheated the prosecutrix or not is a question of trial and at this juncture, it would not be apposite to say that the accused-petitioner has duped the prosecutrix. The trial of the case may take considerable time, therefore, considering the above facts and without expressing anything on the merits of the case, I deem it just and proper to enlarge the accused-petitioner on bail. 6. Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioner Shubham Singla S/o Naresh Kumar Singla, in connection with FIR No.164/2024 registered at Police Station Sindhi Camp, District Jaipur (West), shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for [2025:RJ-JP:8908] (3 of 3) [CRLMB-2183/2025] his appearance before the court concerned on all the dates of hearing and as and when called upon to do so.
